PrivacY Policy Overview

This policy describes the data that personally identifies you (“Personal Data”) processed by or on behalf of Raymond Leasing Corporation and Toyota Industries Commercial Finance, Inc. (collectively, “Lessors”, “we”, “us”, or “our”) or its service providers through this website (the “Portal”), and how Personal Data is used and shared.

 

We may modify this policy at any time. All changes will be effective immediately upon posting to the Portal. Material changes will be conspicuously posted on the Portal or otherwise communicated to you.

Lessors as Processors, Sub-Processors or Service Providers

When we act as a service provider, data processor, or sub-processor for our customers, including your employer, an entity that markets products that are financed by or leased from Lessors, we collect Personal Data on behalf of our customers subject to our contractual obligations.  When we act as a service provider, processor, or sub-processor, we follow the instructions of our customer on how to process Personal Data on our customer’s behalf.

Data Collection

You can visit and use portions of the Portal without providing any data that personally identifies you.  If you elect to provide to us any Personal Data, such as your name and email address, we will collect it and use it pursuant to this policy and applicable law.  To create a Portal account, you must provide certain Personal Data and create a new password.  This data is used to populate a profile within your account.  Depending on how you interact with us, we may collect the following categories of Personal Data from you, your company, or our third-party service providers:

  • Identity Data – name or username;
  • Contact Data – email address, phone number or company address;
  • Profile Data – company name; or
  • Communications Data – emails or other communications that you send us.

 

Data Automatically Collected During Portal Use

Account Activity.  We or our third-party service providers may collect Personal Data about how you use the Portal when you are logged into your account.  We may also collect information regarding your device or browser.

IP Addresses; Cookies & Similiar Tracking Technologies.  When you use the Portal, we may use strictly necessary cookies (i.e., small pieces of data stored on your device’s hard drive by your browser) to make the Portal function.  Strictly necessary cookies are always on when you visit the Portal.

Primary Purpose and Sharing Personal Data

We and our suppliers may use and disclose Personal Data as described below.  We do not sell or rent Personal Data except as stated in this policy.

To Provide the Portal.  We may use your Personal Data to provide the Portal or our products to you and your company.

Communication with You.  If you contact us for support or assistance, we may use Personal Data to contact you and assist you with your request.  We may use Personal Data to notify you of Portal changes (e.g., changes to this policy).

Third-Party Suppliers and Consultants.  We may share your Personal Data with our affiliates, third-party service providers, suppliers, consultants, agents, distributors, sales representatives, dealers, resellers, and other partners that provide data processing services to us (e.g., to support the delivery of, provide functionality on, or help to enhance the security of the Portal or our websites, services, or products).  We take appropriate safeguards to require that your Personal Data will remain protected in accordance with this policy and applicable privacy laws.

Security & Protection of Rights.  We may use Personal Data and share it with third parties if we believe it is necessary to operate the Portal, to comply with law, or to protect our rights or the rights of others, including disclosing data necessary to identify, contact, or bring legal action if our contracts, terms, or policies are violated, or if required pursuant to a law enforcement or legal requirement.

Business Transactions.  We undergo corporate transactions from time to time, such as changes in control, acquisitions, mergers, reorganizations, or asset sales.  We may share Personal Data with third parties in connection with the evaluation of those transactions.  In addition, we may transfer Personal Data is we enter into those transactions.  In addition, if we (or our assets) are acquired or if we go out of business, enter bankruptcy, or go through some other change of control or reorganization, Personal Data could be one of the assets transferred to or acquired by a third party.

Aggregated Data.  We may use Personal Data to create aggregate data that is anonymized.  We may use and share such aggregate data with our affiliates, dealers, solutions and support centers, suppliers, and other third parties to: analyze, develop, and improve the content, materials, products, and services that we make available, inform business strategies, understand the Portal’s demographics and user preferences, customize users’ Portal experience, including personalization and automation of content, and for other lawful purposes.

Secondary Purpose

If we wish to use your Personal Data for a new purpose, not covered by this policy, then we will provide you with a new notice explaining this new use prior to commencing the processing and setting out the relevant purposes and processing conditions.  Where and whenever necessary, we will seek your prior consent to the new processing, unless authorized by law.

Storage

Your Personal Data will reside on servers located in the United States.

International Transfers of Your Personal Data

In operating the Portal, your Personal Data may be transferred to, stored in, and processed in countries other than the country in which you are resident. Our website servers and some of our service providers are located in the United States and our affiliated companies and third-party service providers and partners operate around the world. This means that when we collect your Personal Data we may process it in other countries.

We have, however, taken appropriate safeguards to require that your Personal Data will remain protected in accordance with this Privacy policy. If you are located in the EEA, any transfer of your Personal Data outside the EEA will be based on the EU Commission’s Standard Contractual Clauses or other valid legally basis for such transfer.

Your Rights and Choices Regarding Your Personal Data

In certain circumstances, you may have the following data protection rights:

  • You may request access to, correction of, or deletion of your Personal Data.
  • In addition, if you are a resident of the EEA, you can object to the processing of your Personal Data, you can ask us to restrict processing of your Personal Data, and you can request portability of your Personal Data.
  • Similarly, if you reside in the EEA and we have collected and processed your Personal Data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.
  • If you reside in the EEA, You have the right to complain to your data protection authority about our collection and use of your Personal Data. For more information about submitting a complaint please contact your local data protection authority.

To process your request, we may request information from you to verify your identity.

Third-Party Websites

The Portal may link to, or be linked to, websites not controlled by us. We are not responsible for third-parties’ privacy policies or practices. This policy does not apply to any third-party websites or to any data that you provide to third parties. You should read the privacy policy for each website that you visit.

Data Security

Data storage and transmission can never be completely secure. We do not guarantee that loss, misuse, or alteration of Personal Data will not occur. We use appropriate technical and organizational measures to ensure a level of security appropriate to the risk for all Personal Data processed. The confidentiality of your password for your Portal account is your responsibility.

Children

We are committed to protecting children’s privacy.  The Portal is not directed at children under 18 years of age.  We do not knowingly collect, use, or share data from children under 18.  If a parent or legal guardian learns their child provided us with Personal Data without his or her consent, please contact us.

Nevada Consumers

Although we do not currently sell your Personal Data, Nevada law gives Nevada consumers the right to opt-out of any future sale of your Personal Data in the unlikely event we change our practices.  To exercise this right please contact us at [email protected].
